1.1 Introduction
These TikTok Shop by Tokopedia Gambling, Gifting and Surprise-based Products Guidelines have been formulated with the express purpose of:- Building a positive shopping environment on TikTok Shop by Tokopedia; and
- Providing users with a confident shopping experience.
1.2 Scope
These TikTok Shop by Tokopedia Gambling, Gifting and Surprise-based Products Guidelines cover all content and product listings on TikTok Shop by Tokopedia. They are not exhaustive or intended to act as legal advice. Sellers/creators are responsible for ensuring that the listing, sale and provision of products on TikTok Shop by Tokopedia comply at all times with applicable laws and regulations. Sellers/creators must seek independent legal advice if they have questions about any applicable laws and regulations concerning their listings and products.Our TikTok Shop by Tokopedia policies and guidelines are updated periodically. Sellers/creators are responsible for checking this page regularly to ensure that they comply with our current policies and guidelines.
Gambling & Gamification
2.1 What is Gambling Content?
Gambling: The carrying out and/or promotion of all gambling activities is strictly prohibited on Livestreams and Videos. Gambling-related products, services and paraphernalia are also not allowed to be sold on TikTok Shop by Tokopedia. Examples include, but are not limited to, allowing users to pay to spin a roulette wheel for the possibility of winning an item of value.2.1.1 What are some examples of Gambling?
Example A: The seller or creator is selling users a chance to roll a dice and guess the correct number. If the user's guess is correct, they will be offered a reward. If not, there will be no reward provided. Example B: The seller or creator is selling unopened oysters, where customers can pick which oysters to open. The pearls inside each oyster are not guaranteed, and customers will need to repurchase an oyster if they want a chance to try again.
Example C: The seller or creator is playing Blackjack while the livestream has a text prompt for viewers to purchase bets.
2.2 What is Gambling Content?

2.2.1 What are some examples of Gamification with elements of chance?

- Example A: The seller or creator is selling lucky scoops of crystals that have different values.
- Example B: The seller or creator is using a spin-the-wheel game to provide users with the chance to win a variety of free rewards.
2.3 How can I avoid gambling content in my product listings?
You should avoid:- Selling or promoting bets in casino-like games that include but are not limited to roulettes, slot machines, wagers, lotteries, sweepstakes, or raffles.
- Using games of chance to sell or promote products. For example: selling entries to spin a wheel that determines the product customers will receive.
- Using games of chance to do free giveaways (see below for requirements on giveaways). For example: giving selected viewers a spin on a wheel that determines a free gift.
- Using games of chance as part of purchase-based incentives (click here for requirements on purchase-based incentives). For example: giving a customer entry to spin a wheel that determines a gift after they have made a product purchase.
Surprise-Based Products (Restricted)
To promote customer safety and better-informed purchases, surprise-based products are restricted on TikTok Shop by Tokopedia. Sellers who wish to list Surprise-Based products must comply with the following requirements:

| Surprise-based boxes/ packages/ bundles | The product(s) contains single/multiple items that are securely sealed in a box/package/bundle at a factory. The possible product, product quantity, category and variation that could be included in the box are known to buyers; however, the final products that the buyer will receive in the box/package/ bundle are unknown until the product is opened.Examples include, but are not limited to Mystery Box, Golden Eggs, Advent Calendars, and Surprise Trading Card Packs. - 'Giveaways' refer to instances where the customer performs a task to win free gifts without purchasing a product.
- 'Purchase-based incentives' refer to instances where the customer is eligible for free gifts after purchasing a product.
4.1 Giveaways
You must use the LIVE Giveaway feature to conduct giveaways on TikTok Shop by Tokopedia. The LIVE Giveaway feature is a platform function that facilitates product giveaways between you and customers. Two main types of giveaway scenarios are currently supported in the LIVE Giveaway feature.- "Join to Win" Countdown Giveaways refers to a method of entering a seller/creator's giveaway by joining their Livestream.
- Example - 'Join my livestream and receive a t-shirt worth $10. I will pick ten lucky winners in the comments. If you are one of the winners, you will get a free gift.'
- "Comment to Win" Countdown Giveaways refer to a method of entering a seller/creator's giveaway by commenting on their Livestream.
- Example - Join my live giveaway by clicking on the pink basket on the upper left corner to find out the word that you need to type in the comments for a chance to win a free gift.'
4.2 Purchase-Based Incentives
There are three types of purchase-based incentives allowed on TikTok Shop by Tokopedia:- Buy one, get one free refers to instances where customers can purchase an item and receive the same additional item for free)
- Example - If you buy this lipstick, you will also get our travel-size lipstick for free! Your free item will come together with your order
- Buy one, get one or several item(s) free refers to instances where customers can purchase an item and receive different items for free)
- Product listing title: Red Lipstick (Buy one, get a free travel-size mascara)
- Buy X items, get Y set of gifts through TikTok Shop by Tokopedia Promotional Tools (e.g. Gift with Purchase (GWP) promotion tool)
- Example - If you buy 1 hat and 1 pair of shoes, you can get 1 pair of sunglasses for free
- The free gift(s) or incentive(s) must be listed in either product title, product image or product description.
- The free gift(s) or incentive(s) must be consistent with what was promoted.
- All customers must receive the same free gift(s) or incentive(s) of the same price and category.
- The free item can not be cash, virtual currency or gift cards.
- The following terms of the purchase-based incentive must be explicitly stated on the relevant content (e.g., Livestreams and video) or product listing:
- The mechanism of the free giveaway (e.g. buy one, get one free)
- The free gift or incentive
- The duration of the free product(s) being made available (e.g. During the duration of the Livestream only)

5. What happens if I breach these guidelines?
If you are found to violate these guidelines, you may have enforcement actions taken against your account. Can I promise cashback on a product and give shop credits instead?
- Transparency is crucial. Inform participants or customers immediately, apologise, and offer an alternative solution.
- Yes, if it's clearly specified that the cashback will be in the form of shop credit. This is to avoid ambiguity and ensure customers are informed.
