The protection of others' intellectual property rights is critical to keep our platform secure and safe. You should take note of the following types of Intellectual Property Rights:

What would happen if I commit an IPR infringement?

If you have committed an IPR infringement, you will be subject to enforcement actions set out in our TikTok Shop by Tokopedia Seller Performance Evaluation Policy and TikTok Shop by Tokopedia Seller Terms of Service.If you receive a notice or warning of infringement and believe the rights owner or TikTok Shop by Tokopedia made an error, you may appeal or dispute the claim by raising a ticket/appeal in the Seller Center. For more information on the appeals process, please refer to the Appeal Guidelines for IPR Penalties. Please refer to the section on Supporting Documents for Appeal for information on the documentation you may require.

How can I reduce the risk of Intellectual Property Rights Infringement?

The following tips may help to reduce the risk of IP infringement. These tips are for general information only and are not to be intended as legal advice. If you have questions or concerns regarding your rights or obligations, you may wish to seek independent legal advice. You are responsible for complying with applicable laws and TikTok's platform terms and policies.

Conduct pre-listing checks
  • Ensure that your supplier is authorised by the IPR Owner to distribute or sell the product in the country of sale.
  • Verify if the IPR is registered in the country of sale via the official Intellectual Property Offices (IPOs) databases like the Global Brand Database of the World Intellectual Property Organization or seek independent legal advice where necessary.
  • Do not list products that do not originate from the IPR Owner. Always ensure that you have relevant written authorisation from the original IPR Owner.
  • Do not list a product if you do not have a Letter of Authorization (LoA) specifying the right to sell and/or to use any IP from the IPR owner in the country of sale.
Prepare documents prior to product listing
  • Obtain an LoA valid for the country of sale from the IPR Owner or Distributor before listing a product.
  • Keep a copy of your IPR certificate if you have registered your IPR. Ensure the IPR status is active and is registered for the country of sale.
  • If you designed your own product, you may want to contact a lawyer to advise you on your rights.
  • Do not dispose of purchase receipts and invoices in the last 12 months as they may be required for appeals.
    Do your due diligence and ensure compliance
    • Ensure all content on the Product Detail Page (PDP) (e.g. images and descriptions) are original. Otherwise, ensure that you have an LoA from the IPR Owner on the right to use their IP.
    • Use terms such as "compatible with" or "made for" if your product is compatible with another brand's products on the Product Detail Page. For additional guidance, refer to the Compatible Products article.
    • Do not use, superimpose or alter trademarks in your product packaging, images and description unless you are the IPR Owner or authorised by the IPR Owner to do so.
    • Do not use images, videos or descriptions found on the internet unless you have a LoA from the IPR Owner on the right to use their IP.
    • Do not refer to or replicate other brands' patented or copyrighted materials and trademarks in your design process.
